ABOUT THE OPERATOR

SOOMI
A trading name of NOAH & MILO INVESTMENTS LTD
Registered in England and Wales
Company number 16786971
Registered office: 128 City Road, London, EC1V 2NX

Questions about these terms can be sent to hello@withsoomi.com.

1. Who we are and how to contact us

SOOMI is an artist operating companion. In these terms, “SOOMI”, “we”, “us” and “our” mean the legal operator identified in the site footer, checkout and your confirmation email. You can contact us at hello@withsoomi.com.

The operator’s legal name, company number and registered office are shown in the site footer. If you contact us about your account or a transaction, include the email address and reference connected with it.

2. Eligibility and your account

  • You must be at least 18 years old and able to enter a binding contract.
  • You must provide accurate information, keep it current and protect your password and sign-in links.
  • One person or authorised studio representative must remain responsible for each account.
  • Tell us promptly if you believe your account has been accessed without permission.

3. What SOOMI is — and is not

SOOMI supplies practical tools for artists to organise, price, present and share their practice. We are not an art marketplace, gallery, agent or representative, and membership does not promise buyers, enquiries, sales, publicity, ranking, representation or professional success.

Any templates, calculations, opportunities, AI-assisted drafts or other tools are working aids, not legal, tax, accounting, valuation, curatorial or financial advice. You remain responsible for checking outputs and making your own decisions.

4. Free membership

Free artist membership includes a public artist profile and private Studio tools. The profile is created and published when the artist account is created; artwork and other Studio records remain private until you deliberately publish or share them. We may change or retire individual free features after reasonable notice where practical, but we will not convert a free membership into a paid subscription without your express agreement.

If a free account has no qualifying sign-in or Studio activity for 90 days, we send a warning to its registered email address. If inactivity reaches 100 days, we may delete or anonymise the account, public profile and non-required personal data. Signing in before deletion cancels the scheduled deletion. Active paid memberships are excluded. Transaction, fraud-prevention, tax, dispute and legal records may be retained where required or reasonably necessary.

5. Paid memberships, renewal and cancellation

SOOMI+ membership costs £5 per month or £45 per year unless a clearly displayed promotion applies. It renews automatically through Stripe until cancelled. The checkout page shows the billing interval, total price, taxes (if any), renewal terms and cancellation route before payment.

SOOMI Pro costs £10 per month in total and includes SOOMI+. It is not an additional £10 charge on top of SOOMI+. Any different interval, trial or promotional price will be shown before you subscribe.

You may cancel online from your account. Cancellation stops renewal and access continues until the end of the paid period unless the law requires otherwise. Statutory cancellation and refund rights are not reduced by these terms. If immediate supply of paid digital services affects a cooling-off right, we will ask for the separate acknowledgement required by law at checkout.

The SOOMI+ badge is SOOMI's single public membership badge. It is not artwork authentication, professional accreditation, buyer protection, endorsement or a ranking boost. The separate red SOOMI Ambassador badge records an earned referral milestone.

6. Artwork enquiries, sales and platform fees

SOOMI can provide enquiry forms, artwork pages and payment tools, but the artist remains the seller and the buyer remains the artist’s customer in an artwork transaction. SOOMI provides the platform; it does not own the artwork, become the artist’s agent or guarantee either party’s performance.

The artist is responsible for accurate descriptions, authority to sell, price, tax, delivery, returns, refunds and disputes. Stripe processes payments through the artist’s connected account. Unless a different fee is clearly shown and accepted before publication, SOOMI charges a 10% platform fee on an artwork sale completed through SOOMI checkout. The Artist Seller Terms, SOOMI Payments Terms and Buyer Terms provide the transaction-specific detail.

7. Public profiles and daily features

Creating an artist account publishes a profile containing the artist or studio name supplied at signup. Biography, location, media, styles, links and selected portfolio content become public when you add them to that profile. You can edit or remove optional profile details and may close the account, subject to preserving records connected with an active order or dispute.

Every active published profile is eligible for the same fair daily homepage rotation. Artists may opt out of separate public ranking features where that control is offered. A SOOMI+ subscription does not buy preferential placement, verification, impressions, enquiries or sales.

8. Wallet artist cards

The wallet-card tool is available only while SOOMI+ membership is active. It can create a QR card linking to your public SOOMI portfolio or a published artwork sales page you select, and may support Google Wallet and Apple Wallet where issuer approval, certificates, compatible devices and third-party services are available.

Wallet providers can change, suspend or reject passes. SOOMI does not guarantee permanent availability or compatibility. A wallet artist card is not a payment card, identity document or artwork certificate.

9. Your content and intellectual property

You keep ownership of content you upload. You grant us a non-exclusive, worldwide, royalty-free licence to host, copy, resize, display and transmit that content only as needed to operate, secure and promote the profile or service features you choose to use. This licence ends when the content is deleted, except for cached copies, legal records and content connected with an unresolved transaction.

You confirm that you own the content or have permission to use it, and that publishing it will not infringe copyright, privacy, publicity or other rights. You must not upload unlawful, deceptive, abusive, discriminatory, malicious or rights-infringing material.

10. Acceptable use

  • Do not use SOOMI for unlawful, fraudulent, misleading, abusive or discriminatory activity.
  • Do not upload malicious code, interfere with security, test vulnerabilities without written permission, scrape protected areas or try to access another person’s account or private records.
  • Do not impersonate another person, misrepresent an artwork or its ownership, send unsolicited messages, or use SOOMI to sell prohibited or rights-infringing material.
  • Use opportunity information responsibly and check the organiser’s current terms before applying; inclusion is not an endorsement or guarantee.

11. Suspension and closure

You may close your account subject to unresolved orders, payouts, disputes and legal retention. We may restrict or suspend an account where reasonably necessary for security, non-payment, suspected fraud, unlawful conduct, repeated policy breach or protection of users and the service. We will explain the reason and route to challenge the decision unless doing so would compromise security, an investigation or a legal duty.

12. Service availability and liability

We aim to provide the service with reasonable care and skill but cannot promise uninterrupted or error-free operation. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence, or your statutory consumer rights.

Subject to the previous sentence, we are not responsible for losses that were not reasonably foreseeable when you joined, losses caused by information you supplied, third-party services outside our control, or business losses where you use a consumer membership mainly for business purposes.

13. Changes to SOOMI or these terms

We may change, add or retire service features for legal, security, technical or product reasons. Where a change materially affects a paid feature, we will give reasonable notice where practical and explain any cancellation options that apply.

We may update these terms for legal, security, technical or service reasons. Material changes will be notified by email or in-product notice before they take effect where practicable, and renewed acceptance may be required. The version accepted by you is recorded.

14. Governing law, jurisdiction and complaints

These terms are governed by the law of England and Wales, but consumers retain mandatory protections and may bring proceedings in any court available under applicable consumer law. Contact hello@withsoomi.com first so we can try to resolve a complaint.
